Hotspot|Children born in the United States who do not return to the country for two years are deemed to have automatically given up their Chinese nationality and cannot apply for a travel permit Since I have just applied for a travel permit for my child, I am particularly concerned about the new policy that was implemented on 2015/03/27.
We immediately analyzed a large number of cases and clarified the ins and outs for everyone before the detailed rules were published on the Chinese embassy and consulates’ webpages:
First of all, children born abroad whose parents are Chinese and have not settled abroad have Chinese nationality and need to apply for a travel permit when returning to the country. This rule has been in place for a long time and everyone knows it.
> New regulations: 1. If a child has not returned to China before the age of two, he or she will be deemed to have automatically given up Chinese nationality and must apply for a Chinese visa when returning to China. This new regulation has been confirmed by multiple netizen cases. The implementation date is 2015/03/27, which is yesterday. However, different consulates do not have exactly the same determination of age. The consulate in San Francisco is 24 months and the consulate in Los Angeles is 18 months. 2, According to case reports from netizens, even if you have returned to China before the age of two and then traveled to the United States for more than two years, you will be deemed to have given up your Chinese nationality. You cannot renew your travel permit and can only apply for a Chinese visa. [Ref 4] http://forums.huaren.us/showtopic.aspx?topicid=1802643&postid=66901516#66901516
3, the new regulations are based on the latest supplementary measures to the Nationality Law, and the final right of interpretation belongs to the consul. All parents who have applied for a travel permit for their children know this. The application for a travel permit is the most stringent and must be "visited" by the consul in person before it can be confirmed and signed.
I just went to renew my child’s travel permit. Fortunately, she returned to China before she was two years old, and she only stayed in the United States for less than two years before she could successfully obtain the permit. I feel so lucky!
If your parents do not have a green card and want to apply for a domestic household registration for their children in China, they should apply for a travel permit to return to the country before their children turn two years old. . .
~~~~~A guide to applying for a travel permit~~~~~ After reading the original text of the new travel permit policy, many friends came to ask me about the details of applying for a travel permit for their children. So I decided to write a complete guide on how to apply for a travel permit in San Francisco. I hope it will be useful to everyone.
1. Material preparation, this is the most time-consuming step in the whole process. 1.1. Child materials: birth certificate, US passport, old travel permit (if any). All require originals and copies. 1.2. Parents’ materials: Original and copy of marriage certificate (or marriage notarization), original and copy of passport, new version of I94 printout or original and copy of old version, original and copy of parents’ identity certificate in the United States (I797, I140, green card related documents, etc.). Please make sure you have your child's parent identity documents with you. 1.3. If there are any missing copies, there is a quarter copy machine in the consulate. 2. Fill in the form 2.1. Download the form here: http://www.chinaconsulatesf.org/chn/qianzhen/t554559.htm 2.2. Key options: – For the first time application, the original document can be filled in according to the US passport. If renewing, fill in the form for the expired travel certificate. – The pinyin name must be consistent with the spelling on the original document, not necessarily the Chinese name. – For domestic household registration address, fill in the parents’ household registration address. – Fill in “No” for foreign nationality and “Yes” for foreign passport. The remarks say "Born in the United States" 3. Photo 3.1, a set of four, 2 inches smaller. You can make it yourself: take a photo of your head against a white or light blue background, upload it to http://www.epassportphoto.com/, select China passport as the size, and the website will help you format it. 3.2. If you find it troublesome, you can take photos on the spot at the Consulate in San Francisco. But sometimes machines break. 4. Address and Parking The Embassy address is 1450 Laguna St, San Francisco, CA 94115. The car can be parked on Cleary Ct next to it. There is enough space, but the slope is slightly steep.
5. Application, payment, and collection 5.1. If you decide to go to the consulate to pick up the certificate in a few days, congratulations, just get the number directly. Take credit cards. 5.2. If you plan to ask the consulate to send it home to you, and the consulate does not accept credit cards, please go to the nearby post office and buy a stamped return envelope, which costs $35 for the Money order application fee and $5 for the Money order return postage.
6. Interview with the consul. After the parents have completed the interview, they need to wait for the consul to interview the child in person before they can sign and approve the application. The consul usually comes out every two to three hours. So if you want to reply, go to the post office quickly and buy the money order, otherwise the delay will be three hours.
These are the most complete guides I can provide. If there are any omissions or errors, please leave a message and I will correct them directly in the post. Bless!
