The Ministry of Homeland Security stated in a statement on January 31 that the latest measures are designed to meet the national security and economic needs of the 21st century and help the United States attract new business and new investment, as well as the world's most outstanding talents. The creation of the "Startup Visa" (Startup Visa), strengthening the H-1B work visa program, ensuring that foreigners with advanced degrees in science, technology, engineering and mathematics (STEM) majors are granted green cards, and improving the existing system are all reforms supported by President Obama because they attract and retain immigrants who have the ability to create jobs in the United States and improve the competitiveness of American companies.
Expand the eligibility for OPT extension for another 17 months. In the new reform bill, the Ministry of Homeland Security plans to relax conditions and allow F-1 international students who have obtained STEM degrees in the past (not in recent years) to extend the OPT internship period for an additional 17 months on the basis of 12 months. In addition, as STEM majors continue to change, the Ministry of National Security will continue to incorporate emerging majors into the STEM category.
Allows spouses of F-1 students to study part-time. DHS will also grant additional opportunities for spouses of F-1 students to study part-time and expand the number of “designated school officials” (DSOs) authorized by DHS to recruit international students. This reform will allow the spouse of an F-1 student to study more courses part-time while the other spouse is studying full-time, not just the currently prescribed vocational courses and recreational courses. Schools will also have greater flexibility in determining the number of designated school officials.
Grants work authorization to certain H-4 visa holders. The Department of Homeland Security plans to grant work status to the spouses of certain H-1B visa holders while they wait to adjust status. In particular, H-4 visa holders can obtain work authorization when their H-1B spouse begins applying for permanent resident status through their employer.
Expand the certification materials for outstanding talents. The Ministry of Homeland Security hopes to expand the scope of academic achievement certificates for outstanding professors and researchers, increase the types of certification materials, and allow employers to prove in more ways that applicants are elites in the field. Currently, the outstanding talent immigration visa based on employer submission is limited to certain types of supporting materials.
Relax work regulations for E-3 visas and H-1B1 visas. The new reform will also allow E-3 visa holders from Australia and H-1B1 visa holders from Singapore and Chile to continue working in their current positions for up to 240 days even if the current visa validity period has expired during the waiting period after submitting an extension application on time, allowing them to enjoy the same treatment as H-1B visa and L-1 visa holders.
Start the corporate home beauty plan. The U.S. Naturalization and Immigration Service (USCIS) is scheduled to hold an information summit in Silicon Valley, California, on February 22 to discuss an Entrepreneurs in Residence initiative, inviting high-level representatives from the business community, academia, and federal agencies to discuss how to maximize the effectiveness of current immigration laws in attracting foreign entrepreneurial talents.
