Is this true? Answer: Recently, the Ministry of Labor has imposed many restrictions. We would like to remind PERM applicants that when receiving an audit request from the Department of Labor, they must respond and cannot just ignore it. If you do the advertising activities required by the Department of Labor, but do not fully comply with the requirements of the Department of Labor, the worst case scenario is that your PERM application will be rejected and you will need to resubmit your PERM application. Failure to respond may result in the employer being fined and prohibited from applying for a labor certificate for the employee, with the penalty period not exceeding two years. After replying to the Ministry of Labor's Audit, the Ministry of Labor may issue another notice requiring the employer to restart the recruitment process under the supervision of the Ministry of Labor, which means re-advertising for candidates and requiring applicants to send their resumes to the address designated by the Ministry of Labor. If there are still no qualified applicants after conducting recruitment activities in accordance with the requirements of the Department of Labor, PERM will still be approved. If an employer is asked to restart the hiring process under the supervision of the Department of Labor, do not fail to respond or withdraw the application. After being audited by the Department of Labor, the Department of Labor may grant the employer's request to withdraw the PERM application during the hiring process overseen by the Department of Labor. And the employer can still continue to submit a new application that meets all the regular requirements and reapply for the foreign employee who has withdrawn the application, but the company's recruitment activities for PERM will be supervised by the Department of Labor. In addition, all subsequent PERM applications or job offers for foreign employees made by the employer may be subject to oversight by the Department of Labor if the Department determines it is necessary.
