The Department of Public Safety (DPS) is investigating what happened in Buckeye on Black Friday and whether police officers used excessive force when arresting a 54-year-old man at Walmart. On November 25, an assistant manager spotted 54-year-old Gerald Allen Newman allegedly hiding a video game under his shirt in a video and called the police. Officer Kevin Lodge responded to the scene. Maricopa County Superior Court documents state that when Newman tried to escape, Lodge used a "sweeping kick" to sweep Newman to the ground and arrest him. Newman insists he was just trying to protect his grandson from being trampled on, didn't steal or resist arrest. "This was barbaric cruelty and absolutely avoidable excessive force... We believe Mr. Newman is innocent," Newman's attorney, Nolan, said. Nolan said Newman was not committing a crime or resisting arrest, but was a victim of police brutality. Photos taken after the incident showed Newman bloodied, bruised and wearing a neck brace.
